Marriage is Under Attack Again in Georgia

On November 2nd, more than 76% of the good citizens of Georgia voted to define
marriage as the union between one man and one woman. The amendment also bans
civil unions between same sex couples.
To someone having not been enlightened by several years in law school, this
sounds pretty much like the same thing. But, since Georgia has a "single
issue" provision on any ballot initiatives, homosexuals on Friday sued to
have the election results thrown out because it was a multi-issue measure.
There is a good chance the homosexual lobby will prevail. A few years ago this
would have been a slam-dunk. Now, thanks to the involvement of people like
you, judges think twice before they attempt to legislate from the bench. With
3 out 4 voters in the state supporting traditional marriage, it will be
interesting to see if any of the judges hearing the case will be willing the
take the heat.
So far, Fulton County Superior Judge Constance Russell, who is hearing the
case seems to be leaning toward splitting hairs. She bristled when state
attorney Stefan Ritter began his argument by saying the amendment is "plainly
the will of the people." Russell quickly interrupted him. "Excuse me, Mr.
Ritter, the question here today is whether or not that will was achieved
through an appropriate process," she said.
Her decision will just be the first step in a grueling process that will
likely grind its way through the courts for years.
In every state that has allowed the people to decide, the vote has been
overwhelmingly in favor of defining marriage as the union of one man and one
woman. The same day Georgia voted, 10 other states passed similar ballot
initiatives. None of the votes were even close.
