Supreme Court Lets Ban on Gay Adoption Stand
~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~
In a decision that will have far reaching implications, the Supreme Court of
the United States has refused to review Florida's ban on homosexual adoption.
This decision effectively means states can bar homosexual individuals from
adopting children. Florida is currently the only state banning homosexual
adoption, but lawmakers in several other states are debating similar
measures.
This is an issue that has been smoldering in the Sunshine State since the
original ban on homosexual adoption was passed in Florida in 1977 with the
help of entertainer Anita Bryant. The ban has seen several efforts to repeal
it and multiple lawsuits. All have failed.
Now that the Supreme Court has spoken and turned this issue back to the
individual states where it belongs, you can expect other states to soon
introduce legislation based on the Florida model.
"The State of Florida has made the determination that it is not in the best
interests of its displaced children to be adopted by individuals who engage
in current, voluntary homosexual activity," the appeals court stated in the
original decision. "We have found nothing in the Constitution that forbids
this policy judgment."
And they flatly stated in words that should be tattooed on the forehead of
every activist judge, "The legislature is the proper forum for this debate,
and we do not sit as a super-legislature to award by judicial decree what was
not achievable by political consensus." Amen!!!
