So any error that occurs must always be done with intent?  Think of just how
many people die in car crashes each year... what percentage of such incidents
are intentional? (although perhaps made somewhat more likely by decisions such
as to speed)

Think for example of the cities of refuge that were established within Israel
(Numbers 35).  Seems to me that even in old testament times God did setup
things differently depending on what level of intent there was present in an
action.

I agree that the media has done a lot of things that, as you say, push the
envelope, but that doesn't necessarily imply that in this incident they meant
to break legal boundaries.
