As has often been noted, the core of SCO's claims against IBM are a simple
contract dispute over whether IBM has the right to contribute its own code to
Linux. IBM has now moved for a partial summary judgment which would put an
end to the contract charges; there is commentary on Groklaw, along with the
memo in support (in PDF format). "The individuals who executed the licenses
and were involved in their negotiation, on behalf of both AT&T and IBM, have
offered unequivocal testimony that the agreements were not intended and
should not be understood to preclude IBM's use and disclosure of homegrown
code and contemporaneous documents reflect this interpretation of the
licenses."
